Terms of Service

These terms govern your use of NetWebMedia services and the netwebmedia.com website. Using either means you accept these terms.

1. Services

NetWebMedia ("we", "us") provides AI marketing services: automation workflows, website design and development, short-form video production, CRM, paid ads management, SEO, and social media management. Specific scope is defined in your Statement of Work (SOW) or plan subscription.

2. Accounts

You're responsible for keeping your login credentials safe. Notify us immediately of unauthorized access. You must be 18+ and authorized to bind your organization.

3. Payments

• All prices in USD, processed by Mercado Pago (cards accepted worldwide — MP converts at checkout).
• Setup fee charged upfront. Monthly retainers billed on the same date each month.
• 90-day minimum on all monthly retainers, month-to-month thereafter.
• Late payments past 15 days accrue 1.5% monthly interest.
• We may pause service for accounts past due more than 30 days.

4. Cancellation & refunds

• Cancel anytime after the 90-day minimum with 30 days notice.
• Setup fees are non-refundable once work has started.
• If we fail to deliver the contracted scope, you get a pro-rated refund for the undelivered portion.

5. Intellectual property

• Work product (sites, videos, automations, copy) becomes yours once paid in full.
• We retain a perpetual license to use anonymized case-study data in marketing.
• We retain ownership of our internal tools, platforms, and frameworks (including the NWM CRM engine).
• Third-party assets (stock footage, fonts, plugins) remain licensed under their terms.

6. Client responsibilities

• Provide materials (brand assets, access credentials, approvals) within agreed timelines. Our timelines assume prompt client input.
• Own the compliance of your industry/legal obligations (healthcare, finance, etc.). We'll flag what we see but we're not your lawyers.
• Ad spend is billed directly by the ad platform to your card — not via us.

7. Service level

• Starter / Pro tiers: email support, 24-hour response on business days.
• Max / Scale / Agency tiers: priority support, Slack Connect, 2-hour response on business days.
• We guarantee 99.5% uptime on hosted services (website + CRM).

8. Warranties & limitations

We warrant that our work will be performed with professional care. WE DO NOT GUARANTEE SPECIFIC MARKETING OUTCOMES — traffic, leads, or revenue numbers in marketing copy are historical averages, not promises. Our total liability is capped at the fees you paid in the 3 months prior to the claim.

9. Acceptable use

You will not use our services to host or promote spam, illegal content, hate speech, CSAM, malware, or anything that violates applicable laws. We may suspend service immediately for violations.

10. Governing law

These terms are governed by the laws of Chile. Disputes are resolved first by good-faith negotiation, then by arbitration in Santiago, Chile.
